Choose a Guardian: Who do you trust to raise your children according to your values and beliefs? Can they provide a loving and stable home?

Have Conversations: Speak with the potential guardian(s) about your plans. Are they willing to take on this responsibility?

Document Your Choice: Include your choice of guardian in your will or other legal documents. Be as specific as possible to avoid any ambiguity or potential disputes. Consult with an estate planning attorney to ensure this is done correctly.

Consider Alternates: Select alternate guardians in case your primary choice is unable or unwilling to assume the responsibility. Life circumstances change for everybody, so having backups is important.

Discuss with Family Members: Have open and honest conversations with close family members about your decision, especially if they will have questions about your choice of guardians.

Review and Update: Regularly review your choice of guardian and make updates as necessary. Your family’s needs will change over time. Review and update your documents with your estate planning attorney every 3-5 years or when big life changes occur.

Seek Legal Advice: Please do not attempt a DIY will or online document service. We see many DIY documents that will not hold up in court. Unfortunately, once you pass away – it cannot be fixed, and the end result is out of your hands. Don’t take a chance with something this important.
